The tube site has responded by <a href=\"https:\/\/mashable.com\/article\/pornhub-blocks-utah-because-of-age-verification-law\" target=\"_self\" rel=\"noopener\"><u>blocking access in Utah<\/u><\/a>, one state that passed such a law. Now, Pornhub faces separate, privacy-based legal challenges from across the pond.\u00a0<\/p>\n<p>Activists from the collective<a href=\"https:\/\/stopdataporn.org\/\" target=\"_blank\" rel=\"noopener\"><u> #StopDataPorn<\/u><\/a> filed a <a href=\"https:\/\/mashable.com\/article\/what-is-gdpr\" target=\"_self\" rel=\"noopener\"><u>GDPR<\/u><\/a> complaint in Italy today, accusing Pornhub of illegally processing personal data and sharing it with unidentified third-parties.<\/p>\n<div class=\"mx-auto mt-8 w-full max-w-3xl font-sans text-lg leading-normal md:text-xl md:leading-7\">\n        <span class=\"font-bold text-primary-400\">SEE ALSO:<\/span><br \/>\n        <a href=\"https:\/\/mashable.com\/article\/money-shot-the-pornhub-story-review\" class=\"text-secondary-300\"><br \/>\n            Netflix&#8217;s Pornhub doc sheds light on the adult industry<br \/>\n            <svg class=\"inline-block ml-1 w-4 h-4 font-normal fill-current\"><use href=\"https:\/\/mashable.com\/images\/icons\/spritemap.svg#sprite-arrow-right-thin\"><\/use><\/svg><br \/>\n        <\/a>\n    <\/div>\n<p>According to a <a href=\"https:\/\/stopdataporn.org\/pr\/\" target=\"_blank\" rel=\"noopener\"><u>press release from #StopDataPorn<\/u><\/a>, Pornhub:<\/p>\n<ul>\n<li>\n<p>Doesn&#8217;t ask for consent when processing personal user data. Given that this data is related to people&#8217;s sexual preferences and orientation, #StopDataPorn says it violates <a href=\"https:\/\/gdpr-info.eu\/art-9-gdpr\/\" target=\"_blank\" rel=\"noopener\"><u>article 9 of GDPR<\/u><\/a>.<\/p>\n<\/li>\n<li>\n<p>Shares personal user information with an unknown number of third parties, both external and within the MindGeek network. &#8220;This undeclared dissemination of personal information constitutes an unlawful processing of data that is forbidden by the GDPR,&#8221; says #StopDataPorn<\/p>\n<\/li>\n<li>\n<p>Feeds personal data to a recommender system &#8220;that unilaterally assigns sexual preferences to each individual without their knowledge and not allowing anybody to contest this result.&#8221; This is unlawful profiling, #StopDataPorn claims.<\/p>\n<\/li>\n<\/ul>\n<p>Researchers from the digital rights group <a href=\"https:\/\/tracking.exposed\/\" target=\"_blank\" rel=\"noopener\"><u>Tracking Exposed<\/u><\/a> (now called AI Forensics) and the <a href=\"http:\/\/pornhub.tracking.exposed\/\" target=\"_blank\" rel=\"noopener\"><u>pornhub.tracking.exposed<\/u><\/a> browser extension have gathered evidence for the complaint. Analysis was conducted through scraping (extracting data from a website), explained Tracking Exposed founder Claudio Agosti in the press release. &#8220;We analyzed Pornhub since its abusive and influential recommendation algorithm has never been properly scrutinized, despite being one of the most popular website[s] on the internet.&#8221;<\/p>\n<p>A preliminary report was sent to the Italian data protection authority in March 2022, and another complaint has been filed in Cyprus as well, where Pornhub is legally based in Europe.\u00a0<\/p>\n<p>Pornhub and platforms like it are hoarding information about sexual orientation and people&#8217;s intimate secrets and kinks, said lead attorney of the litigation and digital rights activist, Alessandro Polidoro, in the release.\u00a0<\/p>\n<p>&#8220;It is mandatory to put this massive processing of sensitive data into compliance with data protection law,&#8221; he continued. &#8220;Why are we letting porn platforms harvest personal data without even asking for consent?!&#8221;<\/p>\n<p>&#8220;We will respond through the appropriate process in time, and note that it is our practice not to comment on ongoing litigation,&#8221; MindGeek told Mashable. &#8220;MindGeek is committed to protecting user privacy, and is continuously implementing measures to safeguard the personal data of everyone in its community.&#8221;<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>In the midst of an American moral panic about explicit content, lawmakers have started passing age-verification laws around sites like Pornhub.
